Terms of Service

1. Agreement and Service
These Terms govern your access to and use of DigiBouquet. DigiBouquet lets users create and share digital bouquets containing selected designs, a personal card, and an optional link to music. Some features, when available, may include accounts, credits, purchases, donations, subscriptions, and support services. By using the service, you agree to these Terms.
2. Your Use of DigiBouquet
You may use DigiBouquet only for lawful purposes. A shared bouquet can be viewed by anyone who receives or obtains its unique link. You are responsible for the content you place in a bouquet and for deciding who receives its link.
You may not misuse the service, interfere with its operation, attempt unauthorized access, submit malicious material, harass others, impersonate another person, or create or share unlawful, infringing, misleading, or abusive content.
3. User Content and Sharing License
You retain the rights you hold in original text and other content you submit, such as recipient names, messages, signatures, and music titles or links. By submitting that content, you grant DigiBouquet a limited, non-exclusive license to host, store, reproduce, display, and transmit it as necessary to create, operate, and make your bouquet available through its share link and to provide related support and security functions.
You represent that you have the rights and permissions needed to submit and share your content, and that doing so does not violate another person's copyright, trademark, privacy, publicity, or other rights.
4. DigiBouquet Materials
DigiBouquet's name, branding, site design, graphics, flower and background imagery, software, and other service materials are protected to the extent owned by or licensed to DigiBouquet. Your use of the service does not transfer ownership of these materials or grant permission to copy, redistribute, sell, or exploit them outside the normal creation and viewing of bouquets offered by the service.
5. Music and Third-Party Links
If you add a music URL, DigiBouquet displays or opens the link you provide. DigiBouquet does not upload or host the linked audio on your behalf and does not grant any license to use music or other third-party material. You must have the necessary right or permission to share a linked work and comply with the linked provider's terms.
6. Accounts and Security
If account functionality is available and you create an account or sign in through a supported method, you are responsible for safeguarding your credentials, passkeys, sessions, and account access. Notify us promptly at support@digibouquet.cc if you believe your account or a shared bouquet is being misused.
7. Payments, Credits, and Donations
If payment functionality is offered, payments are processed through Stripe. Displayed purchase, subscription, credit, or donation terms apply at checkout. Purchased credits, when made available, are valid for 2 years from purchase unless a different term is shown at the time of purchase.
Prices, feature availability, promotional or free credits, and payment options may change. Except where required by law or expressly stated at checkout, completed credit purchases and voluntary donations are not refundable. Subscription cancellation and management options, when offered, are available through the applicable billing flow.
8. Copyright Complaints and Content Removal
If you believe content made available through DigiBouquet infringes your copyright, email support@digibouquet.cc with the subject line "Copyright Complaint." Please include:
- Identification of the copyrighted work you believe has been infringed.
- The DigiBouquet URL or other information sufficient to locate the reported content.
- Your name, contact information, and relationship to the rights holder.
- A statement that you believe in good faith the reported use is not authorized.
- A statement that the information you provide is accurate and that you are authorized to act.
We may investigate complaints and remove or restrict access to content when appropriate. This is a general reporting and removal process and is not a representation that DigiBouquet has appointed or registered a statutory copyright agent.
9. Suspension and Changes
We may remove content, restrict access, suspend accounts or features, or modify or discontinue portions of the service when needed to address abuse, legal complaints, security risks, or service changes. We may update these Terms by posting an updated version with a revised effective date.
10. Disclaimers and Limitation of Liability
DigiBouquet is provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the extent permitted by applicable law, DigiBouquet will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill resulting from your use of, or inability to use, the service.
